Motorist Who Mowed Down Cyclist Arrested

On this blog, I have often decried the lackadaisical or even hostile response from law enforcement officials when a cyclist is maimed or killed by a motorist who was speeding, driving while impaired or operating the vehicle in some other illegal manner.

I also try to bring attention to law enforcement officials who are diligent in pursuing those who endanger or destroy lives by hurtling down the road inside two tons of steel.  In Michigan's Macomb County, just outside of Detroit, such work by the constables has led to the arrest of a man who blew through an intersection at 70 MPH, mowed down a cyclist who happened to be crossing the road, and didn't stop or even slow down.

Randy Menendez, a 60-year-old father,  was riding his bike home from a friend's house at 6:27 pm on 3 February.  He'd planned to watch the Super Bowl with his family, according to his sister Roseanne Menendez.  He was crossing Groesbeck Highway in Warren when a gray Dodge Charger with a temporary tag in the rear window, and tinted side windows, struck him.  

He didn't make it. His clothes and mangled bike were scattered across the road.  



Some time after the crash, the driver had the Charger towed to a house in Detroit, where police found it under a tarp.  

The car, it turned out, had been leased.  That no doubt helped police in finding the driver, a 24-year-old man whose name hasn't yet been released.  He faces a charge of leaving the scene of a fatal crash, a felony that carries a 15-year sentence.


Although I commend the police officers' work, I have to wonder whether other charges will be brought against him.  At the risk of seeming vengeful, I'd like to be sure that someone who took a cyclist's--and father's--life with such seeming disregard won't get out for "good behavior" after, say, five years.

She Couldn't Run Far Enough

Too often, drivers get away with murder on cyclists.

I mean that literally.  I have heard and read of too many cases in which a driver who was intoxicated, distracted, malicious or just plain careless rand down someone on a bicycle and never faced any sort of consequence.


Too often, cyclists are seen as folks who "just won't grow up and drive".  Or we're poor, which is just as much of a crime as anything else in a capitalist society.


Either way, authorities think we're inconsequential--or that we "had it coming" to us.


Now, there have been exceptions, and I've reported on a few.  In particular, I am thinking of the arrest, prosecution and sentencing of Charles Pickett Jr., who mowed down five cyclists near Kalamazoo, Michigan two and a half years ago.  He was given a 40-to-75-year prison sentence, with no possiblity of early release.  Given that he had already served two years when he was sentenced, he has another 37-1/2 years to go--which means he won't be eligible for parole until he's 90.


Today I learned of another example of diligence by law enforcement officials in pursuit of a motorist who killed a cyclist.  I must say, the officials involved in this case went well beyond those involved in any other incident of which I'm aware.

In January 2017, Augustin Rodriguez was pedaling to work in Whittier, California.  He wouldn't make it:  a white Lexus plowed into him from behind.


After hitting Rodriguez, that driver "slowed down briefly and then sped up," dragging him several hundred feet under the car, according to FBI documents.  Then the driver fled.


Fifteen minutes later, medics declared Rodriguez dead at the scene.


 A week after that, an anonymous caller pointed Whittier police in the direction of that Lexus' driver:  one Andrea Dorothy Chan Reyes.  She, too, was on her way to work--and running late.   Then she kept on running.

She was identified as the driver after employees at a local body shop confirmed that they did front-end work and replaced a broken windshield for Chan Reyes, who claimed that she struck a deer.


Police then searched for the Lexus, which was nowhere to be found--until a string of clues led investigators a month later to Idaho, where the vehicle was found in a garage of a business associate of Chan Reyes.  DNA testing confirmed that the car was indeed the one she drove when she mowed down Rodriguez.


But now Chan Reyes was nowhere to be found.  Five days after the crash, she high-tailed it to Hong Kong, where she has family. Over the next year, she hopscotched between Asia and Australia, using as many as 11 different aliases.


Finally, in April of this year, she was tracked down to Adelaide, Australia, where local police honored a provisional request from the US government and arrested Chan Reyes at the home of her new boyfriend.  She has been in an Australian prison ever since.  


Later this month, a court will rule on her bail request. The expectation is that she will be denied and extradited back to the US, where she would face multiple felony charges.


Whittier police spokesperson John Scoggins would not comment on the case except to say that his department was determined to bring an alleged hit-and-run driver to justice, no matter how far or how long she ran.


I commend his dedication.  I must, however, criticize his choice of one particular word.  To be fair, most people in his circumstances would have used it:  justice.  In a case like this, justice is simply not possible, for justice--whatever it is--cannot bring back a life.  Nor can it "balance the scales" for someone's disregard for said life.   There simply is no justice when one person takes the life of another, in whatever fashion.


The only good outcome in this case--or any like it--is that the authorities take it seriously.  That is to say, they treated it as what it is--one person killing another through negligence or disdain.

A Ride Of Silence To Speak For Him

In Greek tragedies, the hero falls to a combination of circumstances and his or her personal failings or shortcomings.

One of the reasons such stories endure is that they make the world make some kind of sense.  The combination of situation and personal flaw give a sense of symmetry, if not justice, to the demise of the hero.

Of course, it doesn't always work out that way in life.  Sometimes a person meets his or her fate due to an incident that he or she did not bring on and cannot control.

Such is the story of Roger Grooters, who went on a ride to help people whose lives were changed for the worse by a circumstance not of their making.  


Eight years ago, the Deepwater Horizon Oil Spill (better known as the BP Oil Spill) spewed seemingly endless streams of crude oil into the Gulf of Mexico, befouling beaches in five US states and Mexico and leaving birds, fish and marine mammals sick, helpless or even dead.  Grooters wanted to help the people from whom the spill their property, livelihoods and health.  

His pastor and fellow church congregants told him there was nothing tangible he could do.  He thought otherwise.  So, on 10 September of that year, he got on his bicycle in Oceanside, California, near San Diego, with the intention of reaching Jacksonville, Florida.  He documented his trip, which raised $12,000, on a blog called Roger X Country.

The name of that blog has been changed to We Ride For Roger.  A little more than a month after he started his ride, a pickup truck was barreling down State Road 20 just outside of Panama City, in the Florida Panhandle.  The driver was texting and--unfortunately, you can guess what happened next:  He plowed right into the back of Grooters.

You can probably guess what happened next:  He didn't make it to Jacksonville.  He didn't make it, period.  His ride ended after 2179.4 miles, or about 300 miles short of his destination.

The following year, a group of cyclists that included some of his family members gathered at the crash site and continued his ride to Jacksonville.  He rode to raise awareness of the victims of one disaster; they were riding to raise awareness of the victims of the kinds of disasters that occur all too frequently on roadways in Florida and elsewhere.


The Ride Of Silence


A cyclist has a greater chance of being killed by a motorist in the Florida than in any other state in the Union.  I am sure that at least some of the 100 riders who gathered yesterday at Pensacola State College were aware of that. They participated in a seven-mile "Ride of Silence" along the city's streets in drizzle and rain.  At the beginning of the ride, organizers read the names of dozens of cyclists who have been killed while riding in the Florida Panhandle as bagpipers played "Amazing Grace".

The riders wore armbands--black for those who'd never been struck by a car, red for those who had.  I couldn't find a count, but from the photos I saw, the red bands were numerous.

Oh, by the way....The driver was so immersed in his texting that he didn't realize what he'd hit until the police stopped him.  He was cited and fined but never apologized to Roger Grooters' family.

When Carelessness And Distraction Collide

In my high school, one of the science teachers was also the soccer coach.   I heard that he used to give his students a "problem":  If a ball is rolling at 10 mph, a 140-pound player is running at it from one direction and a 180-pound player is running from another direction, what will be the trajectories of the players and the ball?

Then he would tell his students, "We can go down to the field and find out."  For the rest of class, they would watch the team (which included me) at practice.

Now here's another real-life physics problem, albeit without much humor:  A woman is driving a Buick at 62 MPH in a 45 MPH zone.  She picks up her cell phone.  

What will happen to the cyclist who just happens to be riding along the same road, in the same direction?

Well, the answer to that one is grim, to say the least.  Jeffrey Gordon Pierce, a 53-year-old teacher at the Inman (South Carolina) Intermediate School was thrown off his bike after he was hit by said Buick, driven by Heather Renee Hall, an Inman resident.

Well, she was an Inman resident until yesterday.  Her new residence, for now, is the Spartanburg County Detention Center.  Jeffrey Gordon Pierce, meanwhile, is in the South Carolina earth:  He died at the scene of the crash.




And, yes, he wore a helmet.  Even that wasn't enough to prevent a horrible crash, let alone influence its outcome, when carelessness and distraction collided.

Although I wasn't happy to hear about another cyclist hit by a car, I was somewhat heartened, if only for a moment, when I read "Woman Sentenced".  Too often, motorists who hit and injure, or even kill, cyclists get off scot-free--or don't get much more than the proverbial "slap on the wrist."

Unfortunately, the latter was actually the case for the woman in the headline.  Yes, she is going to jail--for 28 days.  Now, if she had been like the driver who stayed at the scene after smacking into a 14-year-old Guatemalan boy in Brooklyn last month, I might have thought the sentence too harsh.  But there are other, shall we say, mitigating circumstances.

Those circumstances include the fact that she left the scene--and that she was intoxicated.  But, oh, no, this isn't an isolated incident in her resume:  This is her third drunk driving arrest.

Karen Nugent probably knew that she was facing serious time--say, five years, which is what the law allows for someone with her record in Michigan, where she smacked into that teenager.  So she pleaded guilty and got a deal:  The charges were reduced to a second-offense Operating While Intoxicated (OWI) and not stopping at the scene of an accident.  

I don't know whether I am more upset at Ms. Nugent--or the judge in Benzie County who made the deal with her.
