At Least He Survived--We Hope

Some stories bring me no joy.  But sometimes I feel the need to tell them, if only because they hit close to home.

At least this one hasn't ended in tragedy...so far.


A few days ago, I wrote about Madison Jane Lyden, the Australian tourist run down by an inebriated garbage truck driver as she cycled up Central Park West.  Well, I've gotten word of another cyclist struck by a motorist on a route I ride frequently.


Just before  8 pm yesterday, an 11-year-old boy (whose name hasn't been released) was riding his bike in Far Rockaway, in an area I pass through when I ride to Point Lookout or other points on Long Island's South Shore.  Occasionally, "Far Rock" is even my destination, especially when I'm trying to get a ride in during an abbreviated winter day.  





Anyway, a black sedan slammed into him--and kept going.  The impact sent him airborne for several car lengths. He landed in the hospital with internal injuries, but he is expected to survive.

At least, according to the NYPD, the driver of that car--41-year-old Aghostinho Sinclair--has been arrested.  Needless to say he's in a heap of trouble: The charges against him include reckless endangerment, leaving the scene of an accident--and driving without a license. (The latter charge is called "aggravated unlicensed operation".)  I wonder whether "endangering the welfare of a child" or some similar charge can be added to the list.

She Couldn't Run Far Enough

Too often, drivers get away with murder on cyclists.

I mean that literally.  I have heard and read of too many cases in which a driver who was intoxicated, distracted, malicious or just plain careless rand down someone on a bicycle and never faced any sort of consequence.


Too often, cyclists are seen as folks who "just won't grow up and drive".  Or we're poor, which is just as much of a crime as anything else in a capitalist society.


Either way, authorities think we're inconsequential--or that we "had it coming" to us.


Now, there have been exceptions, and I've reported on a few.  In particular, I am thinking of the arrest, prosecution and sentencing of Charles Pickett Jr., who mowed down five cyclists near Kalamazoo, Michigan two and a half years ago.  He was given a 40-to-75-year prison sentence, with no possiblity of early release.  Given that he had already served two years when he was sentenced, he has another 37-1/2 years to go--which means he won't be eligible for parole until he's 90.


Today I learned of another example of diligence by law enforcement officials in pursuit of a motorist who killed a cyclist.  I must say, the officials involved in this case went well beyond those involved in any other incident of which I'm aware.

In January 2017, Augustin Rodriguez was pedaling to work in Whittier, California.  He wouldn't make it:  a white Lexus plowed into him from behind.


After hitting Rodriguez, that driver "slowed down briefly and then sped up," dragging him several hundred feet under the car, according to FBI documents.  Then the driver fled.


Fifteen minutes later, medics declared Rodriguez dead at the scene.


 A week after that, an anonymous caller pointed Whittier police in the direction of that Lexus' driver:  one Andrea Dorothy Chan Reyes.  She, too, was on her way to work--and running late.   Then she kept on running.

She was identified as the driver after employees at a local body shop confirmed that they did front-end work and replaced a broken windshield for Chan Reyes, who claimed that she struck a deer.


Police then searched for the Lexus, which was nowhere to be found--until a string of clues led investigators a month later to Idaho, where the vehicle was found in a garage of a business associate of Chan Reyes.  DNA testing confirmed that the car was indeed the one she drove when she mowed down Rodriguez.


But now Chan Reyes was nowhere to be found.  Five days after the crash, she high-tailed it to Hong Kong, where she has family. Over the next year, she hopscotched between Asia and Australia, using as many as 11 different aliases.


Finally, in April of this year, she was tracked down to Adelaide, Australia, where local police honored a provisional request from the US government and arrested Chan Reyes at the home of her new boyfriend.  She has been in an Australian prison ever since.  


Later this month, a court will rule on her bail request. The expectation is that she will be denied and extradited back to the US, where she would face multiple felony charges.


Whittier police spokesperson John Scoggins would not comment on the case except to say that his department was determined to bring an alleged hit-and-run driver to justice, no matter how far or how long she ran.


I commend his dedication.  I must, however, criticize his choice of one particular word.  To be fair, most people in his circumstances would have used it:  justice.  In a case like this, justice is simply not possible, for justice--whatever it is--cannot bring back a life.  Nor can it "balance the scales" for someone's disregard for said life.   There simply is no justice when one person takes the life of another, in whatever fashion.


The only good outcome in this case--or any like it--is that the authorities take it seriously.  That is to say, they treated it as what it is--one person killing another through negligence or disdain.

A Story I Didn't Want To Repeat

One of the things my students learn--if they don't already know it--is that the same stories repeat themselves, whether in literature, the other arts, journalism or "real life".

As for the latter:  Yes, another story repeated itself in life.  In fact, it's one I wrote about just yesterday in this blog.  Unfortunately, it's not the sort of account I, or anyone else, enjoys repeating.  But here goes:

Another motorist drove into the back of another cyclist in Florida--in more or less the same part of the Sunshine State, no less.

Yesterday, I told you about Alan Snel.  He survived the ordeal, although he still has a lot of recovery ahead of him.  Frank Atkisson, on the other hand was not as fortunate:  The force of 26-year-old Kristie Jean Knoebel's car ended his life shortly after he was struck while riding at around 7pm the other day.

Although Snel's experience garnered a lot of attention among cycling advocates and journalists--Alan is both--it didn't reverberate through the general population the way Atkisson's unfortunate encounter has.  At least, his tragedy has caused the general public--in Florida, anyway, to take notice.

You might say that it's because Atkisson, unfortunately, died.  But another reason is that he served in the Florida House of Representatives for eight years, and was also a city council member and the mayor of Kissimmee as well as a Commissioner in Osceola County.

I don't want to trivialize his death, or even to seem overly cynical, when I say that his visibility to the people of Florida--especially to his fellow politicians--might be the impetus to make conditions safer in what is the deadliest state for cyclists.

Maybe, just maybe. We can always hope.  But for now, we can only mourn him--and be thankful that Alan Snel is still with us.

Gwen Inglis, R.I.P.

 The other day, before I mounted my bike, I slathered my arms, legs and face with sunscreen. But I didn't replenish it during my ride, so I ended up with tomato-tinted limbs and cheeks.

So, I rode without enough of one kind of protection.  But I wore my helmet and gloves, so at least I shielded myself in other ways.  

There are some things, though, that won't protect you.  They include your current or former status as a champion (if you have such a thing) and, sometimes, riding in a bike lane.

They certainly didn't protect poor Gwen Inglis.   She was the reigning national road race champion for her age group (45-49).  On Sunday morning, she took a training ride in a Lakewood, Colorado bike lane near her home, something she'd done many times. 





Around 10am local time, Lakewood police responded to a call about a crash involving a driver and cyclist.  Inglis was rushed to a local hospital, but couldn't be saved. 

Ryan Scott Montoya, a 29-year-old Denver resident, has been taken into custody.  He is suspected of being under the influence of drugs when he struck Inglis with the compact sedan he was driving.

Gwen Inglis suffered a horrible fate and that if Montoya was indeed intoxicated or simply careless or indifferent, he doesn't get off with a "slap on the wrist," as happens in too many cases of drivers killing or maiming cyclists.  

One thing I wonder, though, is whether that bike lane was simply lines painted on pavement or a real lane separated by barriers of some sort.  When the "lane" is simply paint, it's all too easy for a motorist to veer into it--or use it to pass other cars.  But even when barriers sometimes aren't enough to stop a driver who's high, drunk or bent on destruction.
