A New Policy on Abandoned Bicycles

 They lose their seats and wheels. They rust, corrode and rot. Sometimes parking cars back into, and bend, them. 

I have seen many of them locked to signposts, trees and railings that line sidewalks of this city. Less frequently, I have seen them tethered to public bike parking racks and the ones on campuses and workplaces.




I am talking about abandoned bikes.  Most such bikes aren’t high-end and don’t seem to have been particularly well-cared-for before they were forgotten. You can almost tell they were purchased for not much money or were “inherited” or “rescued.”

 Once in a while, though, I’ll see a relatively high-quality bike still in pretty good condition that’s been left by its lonesome for a few weeks. I imagine that its owner had to move on short notice or had some other kind of emergency.

Whatever the circumstances, the City’s Department of Transportation is trying to cut down on the number of bikes abandoned along the city’s thoroughfares.  To that end, it is establishing a time limit for parking in public bike racks.

According to the new policy, an abandoned bike is “a usable bike that is locked in a public bike rack for more than seven consecutive days.”  Anyone can report such a bike and request removal in order to free up more space.

Once a bike is reported, the DOT will tag it.  If the bike is not removed after seven days, it can be confiscated by the DOT, NYPD or a designated representative and turned over to the nearest NYPD precinct for 30 days. If the bike isn’t claimed, it will be sent to the Property Clerk, which has a convoluted process for requesting return of property.

I have to wonder, though, how effective this policy will be.  For one thing, as I’ve mentioned, abandoned bikes are more likely to be found on lamp and sign posts and railings than on public bike rack—at least in my observation. Also, as Melissa Kravitz Hoeffner points out in her Time Out article, one can “technically “ cut off the tag and keep the bike in place.

Are We 19 Percent More Lawless Than We Were Last Year?

Are New York City cyclists committing 19 percent more traffic violations than they were last year?

As of 1 October, the New York Police Department handed out 23,452 summonses to cyclists in 2017.  During the same nine-month period in 2016, cyclists in the Big Apple were issued 18,991 summonses.

"Ticket blitzes" are a common topic of conversations I have with other cyclists in this town.  Of course, the NYPD--like just about every other police department--denies that its members engage in such practices, or are under pressure to meet quotas.  It does, however, seem that we are ticketed en masse over certain hours, days or weeks.

It also seems that we are ticketed disproportionately compared to drivers.  I take that back:  There is evidence of this.  Officers often say that, under the law, we are operating vehicles and are therefore subject to the same regulations.  They are mostly correct about that. However, I have witnessed many drivers running red lights or talking on their phones while driving.  I have never seen any pulled over and ticketed.  Drivers routinely "gun it" through yellow signals in the intersection nearest my apartment,  and none ever seem to be penalized for it.

And their actions can have far more serious consequences--but not to themselves, usually.  The metal surrounding them offers protection--to them, but not the cyclists, pedestrians (some of whom are residents of a senior center on the corner) or anyone else who happens to be on the outside.

Also, many cyclists feel "targeted" by the police.  I know I did when I was summonsed last year in Harrison:  The cop, on a motorcycle, followed me for about a kilometer to the intersection where I was charged with pedaling through a red light. The fact that it was near the end of the month and the officer told me to plead "not guilty" and just happened to be at the front desk when I appeared in court leads me to think that as a cyclist, I was simply an easy mark.  And, I am sure, other cyclists in New York City and other places are ticketed for that reason alone.

Or it could just be that the NYPD is under some mandate to raise 19 percent more revenue than it raised last year?  Who knows?

Enforcing The Law Without Knowing It

The New York Police Department (NYPD) is notorious for its capricious enforcement of traffic rules.  What's even worse is that too many officers don't know what the rules are for cyclists.

Evan Neuman found that out the hard way.  He was cycling up Allen Street in Manhattan's Lower East Side when a cop pulled up and ticketed him for not using the bike lane on that street.

The thing is, he had been riding on the Allen Street bike lane.  He left it to make a turn onto Ludlow Street.  He got his ticket shortly afterward.

New York State law requires that cyclists ride in bike lanes when they're available.  It also stipulates that we can't ride on the left side of the road (against traffic) or more than two abreast.  A number of New York City cyclists have been ticketed for alleged violations of this law. However, these laws (like many State laws) do not apply in New York City.

Instead, the New York City code says the following: Whenever a usable path or lane for bicycles has been provided, bicycle riders shall use such path or lane except under the following conditions:  (i) when preparing for a turn at an intersection or into a private road or driveway, (ii) when reasonably necessary to avoid conditions (including, but not limited to, fixed or moving objects, motor vehicles, bicycles, pedestrians, pushcarts, animals, surface hazards) that make it unsafe to continue within such path or lane.  

My guess is that many police officers--and members of the general public--believe that cyclists must use the lanes, no matter what.  That may well have been the case of the one who ticketed Evan Neuman.  However, given that a fair number of "New York's Finest" patrol on bicycles, I would expect them to be more familiar with the law.  



Neuman has fought the ticket.  So far, he's lost in Traffic Court and a Department of Motor Vehicles appeals board has rejected his appeal.  Now he's filed a motion in State Supreme Court to have the ticket dismissed.
