She Couldn't Have Seen It Coming, Either

Last week, I wrote about poor Saul Lopez, killed in a freak accident of the sort no cyclist--or anyone else, really--anticipates.

The 15-year-old was riding to school when a truck collided with another, and the impact sent both careening toward him as he crossed an intersection. 

Today, unfortunately, I am going to write about another cyclist who fell victim to an unforeseeable mishap with a motor vehicle.  Aside from the cyclist's victimization, there is some other bad news, but there is some good news--for now, anyway.

The good news is that the 34-year-old cyclist, whose name has not been released, is alive after a power line--carrying 7200 volts of electricity-- fell on her.  The hospital treating her says she suffered burns, but has otherwise not commented on the extent or severity of her injuries.

So, how did the Tigard, Oregon cyclist end up under a live electrical conduit on her?  That's where the bad news comes in:  A driver who has been charged with DUI crashed into the pole bearing the power cable.  Mark Wayne Hunter, 50, has also been charged with recklessly driving the van he crashed, fourth-degree assault and criminal mischief.

The crash occurred at 2 am (local time) this morning in front of the Tigard Police Department headquarters.  A police officer who was walking through the parking lot saw the incident unfold.  That officer  ran over to aid the cyclist amid the downed power lines while waiting for the ambulance that took the cyclist to Emanual Medical Center's burn unit.

Let's hope the cyclist recovers and be thankful that police officer happened to show up at just the right time for something no one could have seen coming.

Murder Charges Against Driver Who Ran Down Cyclists Near Kalamazoo

Five counts of second-degree felony murder have been authorized against 50-year-old Charles E. Pickett of Battle Creek, Michigan.

He's the driver of the blue Chevrolet pickup truck that plowed into a group of cyclists near Kalamazoo.  Debra Ann Bradley, Melissa Ann Fevig-Hughes, Fred Anton (Tony) Nelson, Lorenz John (Larry) Paulik and Suzanne Joan Sippel died in the carnage.  Jennifer Lynn Johnson, Paul Douglas Gobble, Sheila Diane Jeske and Paul Lewis Runnels are still hospitalized.


Authorities aren't yet saying what might've caused Pickett to drive into the group of cyclists, who had been riding together every Tuesday night for more than a decade. 



According to eyewitness testimony and other reports, the truck had been moving erratically half an hour before the tragedy.  That, and other factors, have caused speculation that Pickett might have been intoxicated.  He has no history of traffic violations, or any criminal history, in the state of Michigan.  However, a Facebook page for "Charles E. Pickett" shows a number of sexually provocative messages as well as a profile picture with a skull and revolvers that reads, "Never water yourself down just because someone can't handle you at 100 proof."



When a news crew from a local television station went to his home, a family member threatened to chase them with a front-end loader and followed them in a car before a brief verbal exchange ensued.


Whatever might have caused Pickett to run down the cyclists, I am gratified that the authorities are taking the case seriously.   The victims were parents, grandparents, siblings, friends and beloved members of their communities, not just "cyclists".  There seems to be a real attempt to achieve justice.  However, justice is all that can be achieved. It is not a substitute for a life--or, more specifically, the lives of parents, grandparents, siblings, friends and beloved members of their communities who were out for a ride when, to paraphrase Albert Camus in The Plague, death descended upon them from the clear blue sky.

Gambling With Cyclists' Lives: Cara Cox Lost Hers

Here in New York City, those of us who ride often complain about the conditions of bike lanes and streets, and about the seeming hostility or cluelessness of some drivers.  While we all have our stories about the perils of the street, my experiences of cycling in other parts of the US have shown me that, poorly-conceived bike lanes notwithstanding, we have it a little better than riders in other parts of the country.

Other municipalities and states, I believe, actually are more hazardous than the Big Apple.  One reason, I think, is that much of the nation, particularly in parts of the South and West, are more automobile-centric than this city.  Cyclists are still seen  as anomalies in many places. As a result, drivers don't know what to do when they see us.  Some even feel resentment and hostility toward us for being on "their" roadway.


One city with such conditions, it seems, is Las Vegas.  I was there once, nearly three decades ago, and from what I understand, the city's permanent population has exploded and, as a result, traffic is much denser than it was back then.  So it's not surprising that I've been hearing and reading that 'Vegas has a "problem" with bike-car collisions and that it has a large number of fatlities in proportion to its population.

The latest such casualty is Cara Cox, who was struck by a 74-year-old motorist more than two months ago.  She lay in a coma until her death the other day.  Ms. Cox thus became the ninth cyclist to be killed by a motorist in the Las Vegas area this year. A month before  her accident, 500 cyclists particpated in a safety awareness rally and ride in nearby Summerlin.  The eighth cyclist to be killed, Matthew Hunt, brought them together. "[M]atthew did everything right," according to his brother, Jason. "At this point, it's up to the drivers to pay attention," he added.

That some don't is the reason someone like Alan Snel can say, "Every bicyclist I know can share a story about a motorist endangering their safety."  Mr. Snel is a self-described "cyclist who pays the bills as a newspaper writer/reporter" who has written about Ms. Cara, Mr. Hunt and others who died after being struck by cars victims--as well as other stories about cycling in the area--for the Las Vegas Review-Journal.  He also writes a blog, Bicycle Stories, where I learned about Ms. Cara's tragic death.

"For the life of me, I can't understand how society accepts killed cyclists," he writes, "as just part of the regular carnage out there on the roads."

I couldn't have said it any better.  I hope that the day comes when there will be no need to say it at all.

Allen Brumm: A Cyclist Follows The Law And Is Blamed For His Own Death

Which is worse:  An ill-conceived law-- or a law enforcement official who is ignorant of, or misinterprets, a law?

The death of Allen Brumm seems to beg such a question.

The 57-year-old California cyclist was riding in a time trial when he was struck head-on by an oncoming motorist.

California Vehicle Code 21751 mandates the following:

Passing Without Sufficient Clearance 21751. On a two-lane highway, no vehicle shall be driven to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same direction unless the left side is clearly visible and free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be completely made without interfering with the safe operation of any vehicle approaching from the opposite direction. 

Now, I'm not a lawyer. But it seems to me that the key clause in that passage is "unless the left side is clearly visible and free of oncoming traffic for a sufficient distance ahead".  In other words, if you're driving, you're not supposed to pass unless the left lane is clear for as much distance as you need to pass.

The 35-year-old-driver had pulled to her left to pass another cyclist on County Road 19 in a rural area of Yolo County, west of Sacramento. Mr. Brumm was riding in the oncoming lane.

California Highway Patrol Sergeant Andy Hill, in describing the accident, said "both parties" contributed to the collision.  He did not specify the driver's culpability, but said that Mr. Brumm's fault lay in his riding "as far to the right" as possible.

This is what the Golden State's Vehicle code specifies:

Operation on Roadway 21202. (a) Any person operating a bicycle upon a roadway at a speed less than the normal speed of traffic moving in the same direction at that time shall ride as close as practicable to the right-hand curb or edge of the roadway…. 

 Again, take my reading of this, as a non-barrister, as you will.  But it seems to me that the key part of this statute--as it pertains to the accident in question--is "shall ride as close as practicable to the right-hand curb or edge of the roadway.

The last time I checked, "practicable" does not mean quite the same thing as "possible".  Were Tour de France riders to descend any Alpine road as far to the right as "possible", there wouldn't be enough riders left to continue the Tour de France!  Even the most skilled rider would have a hard time not falling off a virage were he or she to ride as far to the right as possible.

On such roads, riding as far to the right as possible could mean riding on rocks or on the edge of a cliff.  In other situations, it could mean riding on ice or on a soft shoulder that would act as quicksand under a bicycle tire tread.

That last scenario is--from what I've read--what Mr. Brumm encountered.  Riding as far to the right as possible would have meant not riding at all.  So he rode as far to the right as was practicable in that situation.

Once, on a ride in Pennsylvania, I got into an argument with an officer about that very point.  The Keystone State, like many others, has (or had, at that time) language similar to CVC 21202 in its laws.  To the right of the roadway on which I was riding was the muddy bank of a stream, which would have been all but impossible to ride on the road bike I was pedaling.  That road was similar to the one on which Mr. Brumm died--a two-lane county road in a semi-rural area.

I explained to the policeman--who, I believe, was not a cyclist--the near-impossiblity of riding "as far to the right as possible".  He said, "Well, maybe you shouldn't be riding this road."  I think he knew that I didn't live in the area and, to his credit, suggested another nearby road, which I rode back to the bridge in Uhlerstown.

And, of course, I rode as far to the right as was practicable into New Jersey.  Poor Allen Brumm did the same in California and is being blamed for his death.

Death In The Sunshine State

Some people think Florida's climate makes it a cycling paradise.

Me, I prefer the change of seasons.  But I admit that I don't mind going there for a few days, and that I have had many enjoyable rides in the Sunshine State.

However, I am more cautious when cycling there than I am here in New York, or just about any place else.  Florida's roads--indeed, much of the state's infrastructure--is designed around the automobile.  And most drivers--I'm not talking only about the elderly ones--are not cyclists.

So I wasn't surprised to read, a few months ago, that in 2012, as many cyclists were killed by motor vehicles in Florida as in Great Britain, a country with three times as many people and many more cyclists.  That same report said that pedestrians are killed at four times the US national rate.

Having cycled some of the causeways that connect the innumerable islands, peninsulae and other outposts with the mainland, it's easy to understand why there are so many cyclists and pedestrians have fatal encounters with motorists.  Those causeways are, too often, more like speedways:  wide, flat, and without a shoulder.  Worst of all, speed limits are enforced loosely, if at all.

So it was that yesterday, on the Rickenbacker Causeway in Key Biscayne, two cyclists were struck.  One of them was killed; the other is in the hospital.  Even by Florida standards, it was a horrific accident.  A news helicopter caught the grisly aftermath:

If Speed Doesn't Kill

Today I'm going to talk about one of those topics about which none of us wants to think:  accidents.

Specifically, I'm thinking about motorists hitting or, worse, running down cyclists.

One reason it's on my mind is that last night, I had one of the closest calls I've had in a while.  

I had just traversed the Pulaski Bridge from McGuiness Boulevard in Greeenpoint, Brooklyn to Jackson Avenue in Long Island City, Queens--a crossing I've made hundreds of times.  On Jackson, I turned left and followed it to 50th Avenue.  Then I turned right on Vernon Boulevard, which skirts the East River and takes me within a few blocks of my apartment.

Daylight, such as it was, fell into night.  Showers were turning into a downpour.  Even that, in itself, is not so unusual, especially at this time of year.  I exercised my usual caution:  I rode a little bit slower and gave myself extra time and distance to brake.  I expected nothing more inconvenient than wet clothes (I was riding Vera, which has full fenders and a flap, but I had not brought any rain gear.) on the rest of my trip home.  

But as I approached the "Y" shaped intersection of Vernon with 45th Avenue and 10th Street, a car shot out from behind me and seemed to miss my front wheel by inches.  A quick turn of my handlebars saved me.

The intersection was well-lit, so my "blinky" lights and reflective vest should have been sufficient for the driver to see me.  There was no light or "stop" sign in the intersection, and I proceeded as far to the right as I could without making a turn.  

However, that driver had to be going at least twice the speed limit for that street.  And, given that it was early on Saturday night, I wouldn't be surprised to learn that his blood-alcohol level was over the legal limit.



In thinking about the incident, I realize that in every one of my close encounters with automobiles in which road conditions or inadequate signals or signage weren't the cause, the driver was speeding.  And, I would suspect that there was a better-than-even chance that the driver was drinking.

Then, just a little while ago, in doing some research (i.e., surfing the web), I came across this account of a 70-year-old cyclist in India who was mowed down by a speeding mini-bus. As it turns out, the driver has a record of speeding and recklessness.

That got me to wondering whether speeding is the main cause of accidents between cars and bikes in which the motorist is at fault.
