Mellow Johnny Sends A Loud, Clear Message

I love food and music.  So, some of you may find it unfathomable, or even criminal, that I've never been to Austin, Texas.

Perhaps I'll get there one day.  In addition to the sounds and savory stuff, there's another reason to visit.

I mean, even if you don't care about bicycles, how can you not want to check out a place called "Mellow Johnny's Bike Shop?"



Apparently, they're part of a chain in the area, each store with its own management.  So, a policy at Mellow Johnny's in Austin might not prevail at MJ's in, for example, Fort Worth.

Actually, that scenario is not as hypothetical as I made it seem. In fact, the Austin shop has done something that the managers of the Fort Worth store aren't--and don't agree with.

Will Black, the general manager Mellow Johnny's--Austin, has announced, on social media, that the shop won't be selling any more bikes to the city's police department.  "It was a staff-wide store decision," he said, "that we discussed for a pretty good length of time to make sure we were all on the same page and doing the right thing." 



No one incident sparked the decision, he explained.  Rather, he and his employees were concerned that, during Black Lives Matter protests in the city, officers were using the bikes to block Black Lives Matter demonstrators.

On Wednesday, when Black announced the decision, Mellow Johnny's was in the second year of a five-year contract with the police department, which has more than 150 bicycle patrol officers in its downtown area police command.   The shop's action follows similar moves in the industry.  BikeCo, the North American distributor of Fuji bicycles, suspended sales to police forces in June, citing the use of bikes as weapons in protest marches.  That move is significant because Fuji had been one of the major bicycle suppliers to police forces in the United States.

"We are not anti-police," Mellow Johnny's post continued. "We believe our local police will protect us from the threats we are receiving right now" on social media.  Thankfully, there have also been messages of support--which, I suppose, isn't too surprising, given Austin's reputation as a "progressive" community--and the sense of fairness and justice I have seen in cyclists throughout my decades of riding and working in shops.

Going For A Cyclist's Jugular--Or His Neck, Anyway

Getting knocked or pulled--or simply falling--off your bike is almost certain to cause you injury.   Trust me, I know!

So when someone sent along this news clip, I felt rage at the cops.





What isn't clear is what, exactly, the kid did to warrant that kind of treatment. The street was closed off so neither the young man, nor the friends who were riding with him, "obstructed" traffic, as one of the officers claimed.

It seems that those boys did little, if anything, more than to taunt the cops: something that kids of that age, who naturally thumb their noses at authority figures, are wont to do.  


I have to wonder, in the wake of George Floyd'ss murder, what one of those cops was thinking when he went for the kid's neck.

Biking While Black

I read Huey Newton's Revolutionary Suicide many years ago.  As I recall, it recounts, among other things, his and his peers' often-tense interactions with the police of his native Oakland.  Many of the incidents would today be called Driving (or Walking, Barbecuing, Reading or Fill-in-the-Activity of Your Choice) While Black.

Frustration over such incidents inspired him and his friends to start the Black Panther Party.   Whether or not you agree with his way of dealing with the poverty, racism and violence that defined life on the mean streets where he grew up, it's hard to argue against his observations and analysis.  After all, so much of what he described could have happened yesterday.

As a matter of fact, it did--or, two weeks ago, anyway.  On 3 August, Najari "Naj" Smith was leading a group of 40 young cyclists through the streets of Oakland on a regularly-scheduled First Friday ride.  You guessed it:  He and most of those cyclists are black.  

They all belong to organizations that consist mainly of African-American members.  One of those organizations, Rich City Rides, was founded and is led by "Naj" himself in the nearby city of Richmond.  RCR teaches young people bicycle mechanics and gives them opportunities to work for their own bicycles.  It also offers guidance on healthy lifestyles and positive social interactions through group rides, public path maintenance and civic advocacy on transportation issues.  

It should be noted here that Richmond today, in many ways, parallels the Oakland of Huey Newton:  It is darker (in skin tone) and poorer than surrounding Bay Area communities.  It also, until recently, had one of the highest violent crime rates in the nation, and many residents feel they are always "under suspicion" by the police.  Oakland, on the other hand, is quickly gentrifying as even well-paid professionals find themselves priced out of San Francisco and other communities on the west side of the Bay.  This has exacerbated tensions between the remaining African-Americans and the Oakland Police Department (which disproportionately stops and arrests African-Americans) not to mention the white gentrifiers who too often call the police when black people simply live their lives in public.

Such was the case two weeks ago, when someone apparently complained about Naj and the other riders when they formed a "bonding and healing circle".  A police officer broke into it without warning and grabbed Naj's handlebars.  

The officer explained that Naj was being detained for "excessive noise" coming from a stereo on a trailer behind his bike.  Smith says he immediately complied with the officer's request and turned off the stereo.  The officer told him to "stay put" and momentarily walked away.  Smith thought the officer was going to write him a citation.  Instead, the cop handcuffed him, confiscated his bicycle and stereo equipment and whisked him off to the Santa Rita Jail, where he spent the weekend.   Smith made his $5000 bail and has  a court date for the 31st of this month.


"I cooperated with the officer as much as possible," Smith said. Members of the group were upset and he was "trying to put the best example forward" so the incident "wouldn't turn into a mess."


It seems, though, that no amount of compliance is any match for police officers who make up the rules as they go along.  According to Oakland PD spokesperson Felicia Aisthorpe, Smith was detained for "interfering with traffic and playing music too loudly."  Moreover, she said, he did not have proper identification. The officer who stopped me in Harrison two years ago was looking to make the same charge against me.  As it happened, I had my New York State non-drivers' ID with me.  He tried to claim that he could arrest me for not having "official" ID; I countered that the document was issued by the New York State Department of Motor Vehicles and is therefore official.  He wasn't too pleased with that; so he wrote a citation with the largest fine he could get away with.  

Since then, I've checked with a number of reputable sources, all of whom confirmed what I'd already known:  that there is no law in New York State (Harrison is in Westchester County) or anywhere in the US that requires people to carry ID or to show it to police officers. But I carry mine with me anyway for situations like the one I've described.

Whether or not "Naj" Smith had his ID on him or needed it probably isn't the real issue, as far as Ms. Aisthorpe and the arresting officer are concerned.  He is from Richmond and he was in Oakland, cycling while black.

When Toys R Us Didn't Deliver, This Officer Did

Chances are that if you are reading this blog, you didn't purchase your bike at Toys R Us.

But you may have bought one for a daughter, son, grandchild, niece, nephew or other child in your life.  You will not be judged--by me, anyway--if you did.  After all, most such bikes are ridden into the ground, sometimes literally.

Of course, buying anything from Toys R Us is a risky proposition these days, as the chain has declared bankruptcy and is closing its stores.  But I suppose there are bargains to be had, and if you can get one, the risk just might be worthwhile.

(I think I still have a membership card I received when I bought a gift--not a bike!-- for someone's kid or another.  I don't know whether it would actually do me any good now!)

Well, in any event, it seems that when the ship is sinking, some crew members throw their scruples overboard.  That, at least, seems to have been the case in a Temperance, Michigan store.

Hayley McClellan Rowe bought a bike for her 10-year-old daughter, Shelbie, last month.  As she relates on Facebook, the bike was damaged during assembly.  She returned it and purchased another bike, which was to be assembled by store employees. The receipts for the return of the first bicycle and the purchase of the second were stapled to the box in which the second bike arrived.

When she went to pick up the bike, however, employees could not locate the receipts and the bike was sold to another customer.  Neither the store's management nor the company's offices helped her, even after they were contacted by The Blade of nearby Toledo, Ohio.


Among that city's police officers is a fellow named Daniel Henderson.  He saw Ms. McClellan Rowe's Facebook posts and helped her--and daughter Shelbie--in a way the law couldn't.

He bought her a new bike.

Ms. McClellan Rowe said when she calls the police, she expects help "with the situation at hand."  She did not, however, "expect him to purchase a bike out of his own pocket."

Neither did Toledo Police Chief George Kral.  "Officer Henderson went above and beyond the call of duty for this family, for this little girl," he said.

How "Bicycle Friendly" Is It, Really?

Toronto is often rated as one of the world's most livable cities, although many cyclists will challenge its 2015 designation as a "bicycle-friendly" community from Share The Road

One thing that makes the city inhospitable is the same thing that casts a shadow over cycling in other places:  theft. According to a recent report, only one percent of the bikes stolen in Toronto are ever recovered.

I would suspect that New York and other cities have similarly minuscule recovery rates.  I also imagine that, like the people mentioned in a story I encountered, cyclists who get their bikes back are more likely to have done so through their own efforts than with any help from the police.

In August, someone broke into the locker if Joshua Henderson's condo on the Bay Street Corridor and took his BMC racing bike.  He soon located it in a Kijiji listing:  He knew the bike was his and the person who listed it was the thief because the photos in the listing were taken in the locker.

So, Henderson set up a meeting and asked the police to accompany him.  An officer told him to postpone the meeting, and he did.  But when he couldn't contact the investigator the following day, he decided to go on his own.  He filmed the encounter, including the part where the thief fled when Henderson announced that the bike is his and the police were on the way.  

In a way, this story has a not-unhappy ending:  Henderson gave police the video and details of the transaction, both of which they credit for helping them catch the thief, who was wanted in other breaking-and-entering cases. Even after all of that, Henderson says he still feels "anxious" riding his bike.

On the other hand, Corrine Dimnik and her husband are anxious about getting new bikes.  Their Cannondale racing bikes were taken from their condo's underground parking garage in May.  Like Henderson, they saw their bikes listed on Kijiji.

Dimnik says she contacted the seller and scheduled a meeting in front of two uniformed police officers who were taking her statement.  But the officers told her she'd have to reschedule the meeting until plainclothes officers were available.  

About the same time the Dimniks lost their bikes, another was taken from a neighboring townhouse. The neighbor's bike was posted on Kijiji by the same seller but the neighbor was dealing with a different division and got her bike back.  Dimnik told the officer who took her statement about her neighbor's experience but he didn't know anything about it.  

By that time, Dimnik says, the seller wouldn't answer calls about her and her husband's bikes.  They haven't replaced their bikes and, she says, they're not sure that they will. 

I've known a few people who were similarly disillusioned about losing their bikes--and the lack of help they received.  One didn't take up cycling again even after moving to a rural area where bike theft is almost non-existent.

I am sure that there are many, too many, more stories like theirs in the Big Apple, as well as in Hog Town and other major cities--even the ones deemed "livable" and "bike friendly".
