If A Police Officer Rolls A Bike Over Your Head....

If someone rolls a bicycle over someone else's head, could that be construed as excessive use of force?

Hmm...I must admit I'd never pondered that question.  Most likely, there aren't very many people who have. One who had to is Andrew Myerberg.

He is the director of Seattle's Office of Police Accountability (OPA).  The poor fellow who got tire tracks on his forehead was Camillo Massagli, who was known for showing up at street protests and playing his trumpet.  At one of those events last year, held in the wake of a grand jury's decision not to indict Louisville police officers in the killing of Breonna Taylor, Seattle PD Officer Eric D. Walter rolled his Department-issued bike--with two flat tires--over a supine Massagli's head.

Massagli, for his part, declined to pursue charges because, he explained, "I cannot use a penal system I reject for revenge, not in good conscience," though he added that Walter's and other officers' actions showed "disregard for human life."

King County Sheriff's Detective Mike Mellis investigated Walter for assault but did not find probable cause.  He reasoned that Walter and other officers had a right to "peacefully" remove protesters from the street.  Although he conceded that Walter "purposely rolled his bike over" Massagli's head, as recounted in an OPA summary, he said that such an action "would not necessarily be expected to cause someone pain."

Okay...I'll try that if I ever roll a bicycle over someone's head:  "Officer, I really meant no harm!"

At least Mellis, Walter and the officers who worked with him weren't the only ones who had input on the OPA summary.  It didn't dispute Walter's claim that that he "needed to stay on his line and could not move as it might confuse the officers following behind him."  It, however, averred that a review of video from that day found "no indication that he ever lifted the bicycle while walking over" Massagli.  

So what was the result of this investigation?  Walter got a seven-day unpaid suspension. (It's unclear as to whether or not he's served it.) Walter and the union are, of course, appealing it.  As a 14-year veteran of the force, Walter had a base salary of $130,471 in 2020 and made another $20,544. (I wonder whether working that protest was part of his regular salary or overtime.)  So the suspension, should or has he served it, would cost him about $2509 of his base pay. One wonders whether Massagli will pay in some other way--whether through physical pain or emotional trauma, now or in the future, whether or not Officer Walter meant to hurt him.

They See You While You're Shopping

Tomorrow is Thanksgiving Day--and, unofficially, the beginning of the "holiday season"--here in the US.

Although this time is festive for some, it comes with increased dangers.  Among them are "crimes of opportunity," especially in shopping and touristic areas.  Such incidents include car break-ins, purse snatchings, other kinds of theft and sexual harassment and assault.  As one shopper pointed out, a woman alone in a parking lot is especially vulnerable at this time of year, as darkness arrives earlier in the day.

Knowing that, police departments typically increase their presence in such places at this time of year.  Typically, constables pass by in patrol cars; sometimes cops do their work on foot.  But at least one police department has figured out that sending officers to such areas on bicycle is perhaps the most effective means of fighting and deterring crime.

That is what the Kyle, Texas police department will be doing for the fourth year.  The Austin-area city's department specially trains officers for bike duty.  One benefit, according to officer James Plant, is that "we can get into areas that police cars can't." Moreover, he says, bikes are quiet, which allows officers to "be stealthy" and "sneak up on the criminal."

The real value, he says, of the bike patrols is not so much in busting criminals but in deterring them.  The officers on bikes, he explains, are "an extra set of eyes and ears in the community."

And, it seems, people like the bike patrols.  "We get a lot of thumbs-up," Plant says.

What He Enables

I'm no political junkie.  But it's hard to imagine a lower point in the political history of this country than last night's debate.

I think Joe Biden did about as well as anyone could have in the circumstances.  He kept his composure about as well as anyone could have in the presence of Donald Trump.

Note a phrase I repeated in the previous paragraph:  "about as well as anyone could have."  The thing about Trump, I believe, is that he knows, deep down, he can't win a reasoned intellectual argument.  So he lies, gaslights, impugns character and otherwise attacks people in ways that can't be responded to under Robert's Rules of Order, or even the Marquis of Queensbury rules. 

Why am I writing about this on a blog about bicycling?  Well, I think Trump's behavior has implicitly given permission for folks who have power and strength--whether it's financial, institutional or purely physical; whether it's sanctioned by the State or some other recognized authority--to wield it deliberately or without discretion against those who are more vulnerable than themselves.


An example of what I'm talking about took place in Seattle, where a police officer rode his bicycle over the head of a protester:



Amazingly, that protester, known locally as "Trumpet Man,"  didn't end up with anything worse than some shoulder and neck pain.  Some might say the officer did what he did unintentionally.  Even if he did, he should be called to account:  At the least, he can use some re-training.  If his actions were deliberate, of course, he should be fired.  While most of us would assume--rightly, probably--that Trumpet Man was lying down as a form of peaceful protest, he could just as easily have been, as he pointed out, a mentally ill or addicted person who was having a seizure.

In several of my posts, I have pointed out that motorists very often don't realize (or care) that they are operating a potentially-deadly weapon, especially if they drive it into the path of a cyclist or pedestrian.  Well, to be fair, I am going to call out anyone who uses a bicycle in a like fashion--especially if the State bestows upon him the power of life and death.

A Huracan vs A Housewife

There are reasons why police departments all over the world have bicycle patrols.  The main one is that an officer pedaling two wheels can reach places, such as congested downtown streets and alleyways of campuses, inaccessible to the cop with his or her foot on a gas pedal.  And, the constable on two wheels can get to a scene more quickly than his or her counterpart in a motorized vehicle.

What most police department brass don't know, however, is that one of its officer's legs can generate 573 horsepower on a bicycle. 

All right.  That's just a slight exaggeration.  In this one instance, however, a Japanese cop on a bike was a match for 573 horsepower of Italian automotivery. (All right, I made up that last word.)  Or, at least, those 573 horses--costing more than a lovely Louisiana abode that wouldn't look out of place in Gone With The Wind--couldn't escape from justice delievered from the seat of "a housewife-style chari bike.



For years, I've heard that red cars are more frequently pulled over than vehicles of any other color.  It makes sense: If you're going to speed, make illegal turns or do almost anything else you shouldn't be doing while driving, you're more likely to be caught if you catch an officer's eye while doing it.  And, of course, you are more likely to get such unwanted attention if your car has a bright, eye-catching hue.   

Now, of course, if you're buying a Lamborghini, you're probably not trying to be inconspicuous. So, of course, you'll go for a color like the bright orange of the Huracan in the video.  But even if that car had been painted in primer gray, its driver wouldn't have escaped the cop on the "housewife" bike.  Why?  Well, that cop had the law on his side.  No, I'm not talking about Japanese traffic code:  I mean the law of gravity.

It's Not A Chase! Really, They Swear It's Not!

During my formative years, I went to more than a few movies that featured car chases.  But, I swear, I was dragged to them kicking and screaming.  Really, I was!  

You see, most of my trips to the cinema (That's what I call a "movie house", now that I'm a snotty intellectual!) were made in the company of my father and three brothers.  My mother is not particularly a movie fan, let alone a cineophile, although whenever I go to visit her, we  see a movie together--albeit ones that involve more human interaction than piston-powered pursuits.


Still, I admit, I can get a thrill out of watching a chase.  Back in the day, I usually rooted for the pursued even though I knew he (Yes, he was almost always male, as was the pursuer.) would get caught.  When I watched this video, though, I was actually on the side of the chaser--and he's a police officer!





Of course, his being on a bike has something to do with it.  Also, he was chasing the driver of an ATV, which is illegal to drive on the streets of Washington DC--and most cities.  Thankfully, I haven't encountered nearly as many of them as I've seen motorized and electric bikes in the the bike/pedestrian paths!


As far as I know, that officer wasn't seriously hurt.  And I'm glad he was trying to do his job--though his employers deny that it was a chase--or, at least, that it did not follow the DC police department's "no chase" policy when it comes to ATVs.

Rather, the officer was "following" the ATV rider, according to spokeswoman Karimah Bilal.  It was "typical of what we do in this type of incident," she added.

They Keep Going Even When There's No Gas

Here in the US, one normally expects to see a bicycle-mounted police officer in a park, on a college campus or in some other place where there are narrow alleys or paths, like large housing complexes.

It seems, however, that cities and towns are figuring out that such patrols can be very useful in downtown areas.  If you have cycled in such places, as I so often have, you know that you can often reach a given destination before a car or bus, especially when traffic is heavy.


That is basically the reason why there are still bike messengers, even when offices have scanners and e-mail systems.  Some things require that actual people physically sign for them, or have to be delivered by hand for other reasons.  When I was a messenger, I routinely made trips from Midtown to the Wall Street area in five to ten minutes that would have taken twenty minutes to half an hour in a motorized vehicle.


But I digress.  Now ever-smaller cities and towns are seeing the usefulness of bicycle patrols.





One such municipality is Wimberley, in the south-central part of Texas, between Austin and San Antonio. With less than 3000 residents, it doesn't have its own police station, so it depends mainly on deputies from the Hays County Constable and the county sheriff's department to respond to emergencies.


As often as not, those emergencies are the cause of traffic congestion in the downtown area.  Emergency trucks have an especially difficult time getting to the scene of an accident, explosion or some other emergency quickly.  In situations like those, saving seconds can mean saving a life.  And, as Constable Ray Helm explains, "those guys on their bikes can get there within 20 seconds" when it might take minutes for a first responders' vehicle. Also, "they can access different parts of the city trucks can't," he notes.


Also, those quick arrivals make it more likely for officers to de-escalate tense situations, like the ones that unfolded this weekend when gas stations ran out of fuel. Tempers flared, and the officers on bicycles avoided traffic tie-ups and were thus might have arrived just in time to prevent a fracas.


In sending constable's deputies on bicycles, the department was also able to use less of its own gasoline--which, of course saves money.  I am sure that would sway a few folks who might not be moved by the other benefits--such as improved community relations (Officers and the public deal with each other face-to-face rather than through a metal encasement.) that accrue from getting officers out of their cars and onto bikes.

Does The Driver Hate Cops--Or Cyclists?

Someone wasn't feeling the love in the City of Brotherly Love.

Around 2:30 yesterday morning, three Philadelphia police officers on bicycle arrived at the intersection of I Street and Erie Avenue to help with the arrest of a carjacker.

Suddenly, a black sedan--possibly a Nissan Altima--with tinted windows bore down, at high speed, a group of Philadelphia police officers on bicycle patrol.



Fortunately for the men in blue, they hopped off their bikes before the sedan tangled them into a mess of twisted spokes and sped off.

According to a Philly.com report, "Police said the driver's actions appeared to have been deliberate."  No! Really?  What I'd like to know is whether the driver of the sedan knew the carjacker, or simply had a grudge against cops--or cyclists.

Firefighter Bicycle

There's a good chance you've seen a police officer patrolling his or her beat on a bicycle.  It's a common sight on college campuses as well as in dense urban areas with heavy traffic.  Bicycles can be ridden between buildings, down alleyways and in all sorts of venues too narrow for cars.  Even when few adults were cycling here in the US, constables on two wheels were not an unusual, if not a common, sight.

There is also a long history of postal delivery on bicycles, mainly for the same reasons officers patrol from the saddle.  Mail carriers on bikes aren't as common as cops pedaling on patrol, at least here in the US, but I understand they still pedal through "rain, snow, sleet and hail" in a few places.  And they are still pretty common in some other countries.

Speaking of history:  I've written a few posts about how bicycles have been used in the military.  As commenter Reese Matthews pointed out, bikes aren't particularly good fighting platforms.  In some situations, however, they are good for transport and reconnaissance, especially in terrain in which motor vehicles can't be used.  And, interestingly, the Vietnamese didn't actually ride their bicycles; rather, they used their two-wheelers "as pack animals" to transport equipment and other goods.

I mention all of these facts because of something I came across:




This firefighter bicycle was made by the Birmingham Small Arms Company in the early part of the 20th Century.  Naturally, the hose caught my eye.    The bike also had special accomodations for an axe and a siren.  And look at that headlight!

While it looks distinctive, I don't know how anybody rode it, especially with the "hump" in the top tube--not to mention what the bike must have weighed!  It's easy to see why bicycles have never had as much of a role in firefighting as they have had in conducting wars, patrolling streets and campuses and delivering mail.  Then again, the bicycle contributes to firefighting in a different way:  Many firefighters ride to keep themselves in shape--especially if they have injuries that prevent them from running--or simply for pleasure.  In particular, I have met many firefighters on charity rides, or other kinds of organized rides. 

They serve. And the bicycle helps them.
